The protection of your personal data is important to us. In compliance with the EU-General Data Protection Regulation (GDPR), we are obliged to inform you about the collection, storage, transfer and processing of personal data of individuals. This information also includes a description of your rights with regard to data protection.

I. Collection of personal data
In principle, personal data are collected directly from you. The processing of personal data provided by you – i.e. data identifying you, or data by which you become identifiable, such as name, address or contact data – is necessary for us in order to fulfil all contractual obligations arising from the agreement concluded with us. Based on your obligation to cooperate, it is inevitable to provide us with the personal data requested by us, since we otherwise cannot meet our contractual obligations. The same applies to any preliminary business relationships, e.g. inquiries, since we otherwise cannot submit a quotation and do not have the necessary data available for a potential conclusion of contract later on.
In order to fulfil the contract concluded with you, it may also become necessary to process personal data received from third parties, e.g. authorities or business partners, for a specific purpose.
In addition, we may process personal data retrieved from public sources, e.g. internet sites, which we will only use for a specific contractual purpose subject to applicable law.
We also gather contact data given on business cards as prospect data, provided you have personally handed over your business card at a trade fair, exhibition or any other meeting. We also use data processing for the purpose of direct marketing (postal advertising or, with express permission, email advertising).

II. Purpose and legal basis for processing
The legal basis is to be found in regulations of European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
1. Consent acc. to article 6 section 1 (a) GDPR
We process your data based on the consent to the processing given by you for one or more specific purposes. You may revoke your consent at any time, whereas the processing prior to such revocation is considered being lawful (e.g. advertising emails sent/received prior to such revocation).
2. Performance of our contractual obligations acc. to article 6 section 1 (b) GDPR
We process your personal data for the purpose of fulfilling our contractual obligations (e.g. delivery, invoicing) as well as for the purpose of initiating business (email requests, quotations).
3. To comply with legal obligations acc. to article 6 section1 (c) GDPR
We process your personal data in order to comply with legal obligations to which we are subject, e.g. obligations towards financial authorities or binding regulations regarding record retentions periods.
4. Pursuance of legitimate interests acc. to article 6 section 1 (f) GDPR
We process data in order to pursue our legitimate interests, provided that our interests are not overridden by your fundamental rights or interests requiring protection of your personal data. In doing so, we are required to take adequate measures, if necessary, e.g. by pseudonymisation or anonymization of data.
 
Our legitimate interests may be based on our interest in direct marketing, since we otherwise would not be able to advertise our products and services. Our legitimate interests may also arise from the enforcement or defense of legal claims.
 
III. Transfer of personal data
We will only transfer your personal data to any third party if provided for by law, or if you have consented to such transfer.
All authorized divisions and employees within our company will have access to your personal data in order to enable them to fulfil their contractual and legal obligations.
In order to fulfil the contract concluded with you, your personal data will be transferred to other companies we usually need to cooperate with in order to meet our contractual obligations, e.g. forwarders and shipping companies, or public authorities asking for data for legal reasons, as for example financial authorities, social security agencies or law courts.
In order to provide our services, we place orders with processors contributing to the fulfilment of our contractual obligations, e.g. IT service providers etc. With these service providers, we have entered into agreements regarding order processing, to make sure that adequate data protection is maintained when your personal data is being processed.
 
IV. Transfer of personal data to companies in third countries or international organisations
The transfer of personal data submitted by you to a third country – these are countries outside the European economic area, i.e. the EU and Liechtenstein, Iceland and Norway- or any international organisation is ruled out.

V. Automated decision-making, including profiling
The processing of personal data submitted by you shall not include fully automated decision-making processes (including profiling).

VI. Storage time
We store your personal data only for as long as it is necessary for the execution oft he contract.
On the grounds of legal requirements, we are obliged to store specific data for a longer time, e.g. accounting documents with relevant fiscal or commercial content: 10 years; commercial and business correspondence: 6 years; information about suppliers, products, quantities, purchases, sales: 3 years.
In addition, other statutory periods of limitation according to the German civil code (BGB) up to 30 years may apply. The statutory standard period of limitation is 3 years from the year in which the claim has arisen.

VII. Your rights
You have the right to be informed about the personal data collected. You are also entitled to ask for rectification of inaccurate personal data.
Under specific conditions, you also have the right to request the erasure of your personal data, the restriction of processing of your personal data and data portability. You also have the right to object against any data processing based on Article 6 section 1 (f) GDPR.
 
The processing of your data is subject to statutory regulations. Only in exceptional cases, we are obliged to ask for your consent. In these cases, you have the right to revoke your consent for any future processing.
Furthermore, you have the right to file a complaint with a supervisory authority responsible for data protection, if you think that the processing of your personal data does not comply with legal regulations.
